The suspect in an Sh1.3 million fraud case has been released

The man detained over a second alleged fraud of Sh1.3 million from a city trader has been released on bail by the Nairobi court. This is after being arrested two years ago for allegedly defrauding a Nakuru hospital of nearly Sh1 million.


On Wednesday, Mr. Samuel Mutua appeared before Milimani Chief Magistrate Lucas Onyina, who granted him Sh200,000 in cash bail while the case is being tried. He was accused of robbing Mr. Edwin Kuraru of about Sh1,320,543.

According to the charge sheet, he received the funds in Nairobi on March 5, 2021, to clear a shipment from India. He was charged with forging the signature of Mr. Paul Tonui, a police officer, on a second occasion.

According to the charge sheet, he allegedly committed the second offense on February 16, 2022, at the Directorate of Criminal Investigations' main office, presenting it as an accurate affidavit.

According to the prosecution, he knowingly and dishonestly uttered a fake affidavit from Mr. Tonui that claimed to be a real one from Kiati Musila. However, Mr. Mutua refuted the allegations and was freed after posting an Sh200,000 cash bail.

Mr. Mutua asked the court to be released on bail and said he wanted the conflict to be resolved outside of court. He claimed that the complainant had already been hired. However, the complainant refuted the claims of an out-of-court settlement and asserted that the accused had shied away from him for two years.

I tried to talk to his business partners but failed. As a result, we had exhausted all options when we reported the case to the Directorate of Criminal Investigations; the complainant told the court. The case will be mentioned on March 23 this year.

Detectives from the DCI detained Mr. Mutua in January 2021 on suspicion of defrauding St. Joseph's Maternity and Nursing Home Nakuru of Sh948,000 through a fictitious shipping deal. He was charged with failing to deliver hospital supplies ordered through his business to the medical center.
